We define a formal semantics of conditionals based on _normatively ideal worlds_. Such worlds are described informally by Armgardt (Gabbay D, Magnani L, Park W, Pietarinen A-V (eds) Natural arguments: a tribute to john woods, College Publications, London, pp 699–708, 2018) to address well-known problems of the counterfactual approach to causation. Drawing on Armgardt’s proposal, we use iterated conditionals in order to analyse causal relations in scenarios of multi-agent interaction. This results in a refined counterfactual approach to causal responsibility in (...) legal contexts, which solves overdetermination problems in an intuitively accessible manner. (shrink)

The medical response to suicide is generally resuscitation, followed by attempts to maximise the patient's recovery. Care is generally withdrawn when it is futile and there is no hope for recovery. Suicidal patients who have completed an advance directive may complicate matters. Should medical providers not resuscitate a patient with an advance directive who has attempted to commit suicide? If stated wishes for care are ignored in the emergency setting, how should decisions be made over time in the event of (...) a successful resuscitation resulting in the need for prolonged therapy counter to the wishes of the advance directive? What are the merits of the stated the wishes of suicidal patient? What if they were depressed at the time of the advance directive? This case highlights the need for consideration of these and other concerns in the care of patients who commit suicide and have an advance directive. (shrink)

Die berühmte Philosophin Hannah Arendt, deren Name heute in Deutschland Schulen, Straße, Institute und auch ICE-Züge tragen, wurde 1906 in Hannover als Kind einer jüdischen Familie geboren. Sie las Philosophie in Heidelberg bei Martin Heidegger, mit dem sie auch eine heimliche Liebesbeziehung verband. Nach der Flucht vor den Nazis 1933 über Frankreich in die USA wurde Arendt mit einem Schlag berühmt, als sie 1963 ihr Buch "Eichmann in Jerusalem" veröffentlichte. Sie machte sich über die Grundlagen politischen Handelns vor allem anhand (...) totalitärer Systeme Gedanken und hielt dabei stets betont Abstand zu allen Denkschulen der Linken oder Rechten.Diese Unabhängigkeit, die sie selbst gerne als "Denken ohne Geländer" umschrieb, ist laut Sontheimer eine der wichtigsten Ursachen für ein nach dem Ende des Kalten Krieges wieder stark gestiegenes Interesse an Arendts Texten. Anhand des Lebenslaufs der Philosophin zeichnet Sontheimer ihre Denkansätze nach. "Das Hohelied der Freundschaft" überschreibt er ein sehr eindrucksvolles Kapitel über die intensiven, zum Teil über viele Jahrzehnte über hunderte von Briefen gepflegten Beziehungen der Autorin zu Zeitgenossen wie dem jüdischen Gelehrten Gershom Scholem, ihrem deutschen Lehrer und Kollegen Karl Jaspers und der US-Schriftstellerin Mary McCarthy. English summary: Jurgen Habermas developed his philosophical ideas as a critical response to the unreasonableness of the Nazi regime, elaborating his critical theories on society and rationality. Habermas sought to comprehend social alienation, leading him to the communicational character of human reason and eventually his critical theory of morality, law, democracy, and culture. Ridha Chennoufi works to trace the evolution of Habermass philosophy, reveal its complexity and coherence, and demonstrate contributions from this close circle of collaborators. The present debate in legal theory is dominated by an unfruitful schism. On the one hand, analytical theories are concerned with the positivity of law, running the risk of missing the law's relation to society. On the other hand, sociological approaches analyze all sorts of social interactions of law, but have developed no conceptual tools to do justice to the autonomy of law. The theory of autopoiesis offers law a chance of getting round the falsely posed alternative between an autonomous (...) rule system or a socially conditioned decision-making process. It is a theory of law that sees the law's autonomy in the self-reproduction of a communication network and understands its relation to society as interference with other autonomous communication networks. Building on the ideas of Humberto Maturana, Heinz von Foerster and Niklas Luhmann, Gunther Teubner uses the concepts of self-organization and autopoiesis to develop a concept of law as a hypercyclically closed social system. This book will stand as a landmark in legal theory and become a standard point of departure in the sociology of law. (shrink)

In the third and fourth parts of the book, Günther shows--in debate with Hare, Dworkin, and others--how argumentation on the appropriate application of norms and principles in morality and law is possible.

Any satisfactory model of the emotions must at once recognize their place within intentional psychology and acknowledge their uniqueness as mental causes. In the first half of the century, the James-Lange model had considerable influence on reinforcing the idea that emotions are non-intentional (see Lange 1885 and James 1890). The uniqueness of emotions was therefore acknowledged at the price of denying them a place within intentional psychology proper. More recently, cognitive reductionists (including identity theorists) like Robert Solomon and Joel Marks (...) recognize that emotions are intentional but, by reducing them to judgments, beliefs, desires, etc., fail to capture their distinctiveness as mental causes (see Solomon 1976 and Marks 1982). In other words, their place within intentional psychology is acknowledged at the price of denying them their uniqueness. (shrink)

Blending biography, gender theory, and political analysis, Gunther-Canada charts Mary Wollstonecraft's transformation from female reader to pioneer feminist author. She shows how Wollstonecraft's pathbreaking _A Vindication of the Rights of Woman_ and other works confronted traditional notions of femininity and authority and provided the first systematic argument for women's political rights. Wollstonecraft's writings represent a rebellion against Jean-Jacques Rousseau's portrayal of women as dangerous coquettes and Edmund Burke's vision of women as beautiful and apolitical weaklings. Her revolutionary political theory (...) challenged the separation of public and private spheres by insisting that women could be rational players in the Enlightenment's script of liberty and individualism. Gunther-Canada gives us a Wollstonecraft who forthrightly confronted the politics of gender and genre and incited revolt against the prevailing view of women as creatures born only to "propagate and rot." _Rebel Writer_ shows how Wollstonecraft's political ideology guided her personal life—she bore a child out of wedlock and later married amid scandal—and how her attempts to unite the personal and the political ended in 1797, with her tragic early death in childbed. For more than two hundred years Wollstonecraft's life has served as a cautionary tale of the dangers of women's participation in revolutionary politics. Now Gunther-Canada shows us how Wollstonecraft subverted the patriarchal plot of political theory and framed an alternative vision of women as citizens, making her truly a "rebel writer.". (shrink)

Manfred Eigen extended Erwin Schroedinger’s concept of “life is physics and chemistry” through the introduction of information theory and cybernetic systems theory into “life is physics and chemistry and information.” Based on this assumption, Eigen developed the concepts of quasispecies and hypercycles, which have been dominant in molecular biology and virology ever since. This volume collects and revises the key essays of Gunther Teubner, one of the world’s leading sociologists of law. Written over the past twenty years, these essays examine the ‘dark side’ of functional differentiation and the prospects of societal constitutionalism as a possible remedy. Teubner’s claim is that critical accounts of law and society require reformulation in the light of the sophisticated diagnoses of late modernity in the writings of Niklas Luhmann, Jacques Derrida and select examples of modernist literature. Autopoiesis, deconstruction and other post-foundational epistemological and political realities compel us to confront the fact that fundamental democratic concepts such as law and justice can no longer be based on theories of stringent argumentation or analytical philosophy.
